The Dangerous Political Drama In Rivers State: Which Rule Of Law Is Tinubu Talking About And Under Which Constitution?

As we watch the political macabre dance unfolding in Rivers State, with the Supreme Court of Nigeria leading other Courts below it (in open cahoots with the henchmen of the Executive Branch), pouring fuel into the fire with bizarre orders, rulings and pronouncements, we are reminded of how the First and Second Republics of Nigeria collapsed under the weight of the reckless intervention of the Federal Governments of the time, in electoral outcomes in the Regions and States (Western Region in the First Republic and Ondo State in the Second Republic).

The marching orders of Tinubu to Governor Sim Fubara to go home and obey the Supreme Court Judgment is a sad reminder of the kind of response President Buhari gave to Governor Samuel Ortom of Benue State when Ortom came to seek the help of the Federal Government to combat the sweeping onslaught of murderous Fulani invaders in Benue State and Buhari told Ortom to go home and learn to live in peace with the Fulani of Benue.

It is most astonishing to hear the interregnum President of Nigeria, Bola Tinubu, who directly and by proxy, has been at the heart of distortions and manipulations that have completely compromised the Rule of Law in Nigeria, declare that only obedience to the Rule of Law will save Nigeria from catastrophe.

We are compelled to ask the interregnum President of Nigeria the following Questions: 

Which Rule of Law?” And “Under which Constitution?”

Are we so blindfolded by other considerations not to see that the Supreme Court of Nigeria has completely abandoned the Distressed Constitution of Nigeria (1999) and the pretense at Rule of Law just for the sake of expediency as dictated by political merchants?

In less than two years, the Supreme Court has departed from the clear provisions of the Constitution even as that Constitution is disputed.

(1) The Supreme Court Ruling regarding the requirement of no less than 25% of valid FCT votes in the 2023 Presidential Election was wrong and a departure from clear provisions. Rule of Law, Jettisoned.

(2) The decision of the Supreme Court in the 2023 Presidential Election, regarding the requirement of Electronic Transmission of Results real-time from polling units is patently wrong. Rule of Law, Jettisoned.

(3) At a time NINAS had countermanded the attempt at Constitutional Amendments to the so called Local Government Autonomy, the Supreme Court Decision Regarding Direct Transmission of Federal Allocations to Local Government was a departure from the provisions of the Constitution under which the Local Government is not a tier of Government. (4) The Supreme Court Decision on the status of the 27 Lawmakers in Rivers State who defected from their Party at a time there was no division, is patently wrong and whatever happens in Rivers State in the days ahead will be in consequence of that wrong decision of the Supreme Court. Rule of Law, Jettisoned.

(5) No less scandalous and distressing is the shocking verdict of the Supreme Court affirming a Death Sentence on Sunday Jackson from Numan, Adamawa State who defended himself from the attack of a Fulani Invader but NINAS shall be pressing for the invocation of the Powers of Prerogative Mercy to save the life of Sunday Jackson from that grotesque judgement howsoever reached.

For as long as we cling unto the Fraud we call “the Constitution of Nigeria (1999)” which render the Rule of Law impossible in Nigeria, as basis of the Nigerian Union and its Democracy, we only deceive ourselves and mock the concept of Rule of Law.

As long as we stand clapping for a Supreme Court that holds our legs apart for the Executive and Legislative Arms of Government to rape the Polity, for so long shall we sink deeper into the Damnation that Unitary Nigeria has become for Nigerians, manifesting in widespread killings by Fulani Militia Invaders, Mass Imprisonment, Monumental Corruption and the kind of Impunity we see all around, until Nigeria snaps, with catastrophic consequences for all.

As EFCC joins the fray by exhuming one of the many skeletons in their vaults, deposited under the nametag of Peter Odili, it takes being blind not to see that the exhumation of that skeleton at this time is the direct consequence of Odili’s stance in the Port Harcourt Drama.

I posit on behalf of NINAS that Rule of Law has been jettisoned in Nigeria and unless something drastic is done very urgently to arrest the situation, those clapping for the dangerous political drama being enacted in Rivers State will be the victims and casualties of the inferno that is being triggered by the recklessness of Nigeria’s Judiciary at the Instance of the Executive and with the connivance of the Legislative Arm. 

As Unitary Nigeria continues in its Freefall on all fronts, (particularly Security and Economic), it is the contention of NINAS that the only viable pathway to arresting the disaster already racing towards us is to formally acknowledge that we cannot continue the construction of the Nigerian Union and the Nigerian Democracy on the damaged Unitary Constitution upon which Nigeria is currently erected AND to therefore immediately suspend preparations towards another round of National Elections in Nigeria under the Distressed 1999 Constitution, AND to initiate a TRANSITIONING Process for the Constitutional Reconstruction of Nigeria, guided by the Five-Point Proposition of NINAS, just as South Africa did in 1990 via CODESA to commence the Decommissioning of the Apartheid Constitutional Order.
